Please read these terms before reserving or participating in an activity. By confirming a reservation, making a payment, signing a waiver or participating, you agree to these Terms and Conditions.
Agreement to These Terms
These Terms apply to reservations and services offered by SANTRAM LLC LIMITADA under the commercial name Wild Riders Adventure Tours, including ATV tours, jet ski tours or rentals, horseback riding, zipline experiences, transportation, combination tours and activities supplied through authorized third-party operators.
The person making a reservation confirms that they are authorized to accept these Terms for themselves and to communicate them to every participant included in the booking.
1Reservations and Confirmation
A request is not confirmed until Wild Riders has accepted it and received the required 50% deposit. Availability, schedules and equipment are subject to confirmation. The customer must verify the date, time, activity, participant count, meeting point and transportation details shown in the confirmation.
Any error must be reported promptly. Changes are valid only when confirmed in writing by Wild Riders through email or WhatsApp.
2Prices, Taxes and Inclusions
Unless expressly stated otherwise, prices are quoted in United States dollars and applicable Costa Rican taxes are additional. The reservation confirmation identifies the services included. Meals, tips, park fees, transfers, extra participants, optional activities and other items are excluded unless specifically listed.
Prices may change before confirmation. A confirmed price will not change except when the customer modifies the booking, government taxes or mandatory fees change, or the original confirmation contains an evident error.
3Deposit and Final Payment
- A deposit equal to 50% of the total reservation is required to confirm the booking.
- The remaining 50% is due on the tour date, before the activity begins.
- Wild Riders may suspend or cancel service if the balance is not paid when due.
- Bank, card, payment-platform or currency-conversion fees are the customer’s responsibility unless stated otherwise.
The customer authorizes charges corresponding to the confirmed services and any later changes accepted in writing.
4Customer Cancellation Policy
Cancellation with at least 72 hours’ notice
The customer may request one rescheduling, subject to availability and any price difference. Unless Wild Riders expressly agrees otherwise in writing, the deposit is applied as credit rather than returned as cash.
Cancellation less than 72 hours before the start time
Payments are non-refundable. This includes partial cancellations, reductions in the number of participants and failure of one or more participants to attend.
5Weather, Sea, Road and Safety Conditions
Activities operate in changing tropical conditions. Rain, cloud cover or an unfavorable forecast does not automatically cancel a tour. Wild Riders, the assigned guide, captain or operator determines whether conditions are reasonably safe based on the activity, location and information available at the time.
Wild Riders may delay, change the route, substitute an equivalent activity, shorten or cancel a service due to unsafe weather, sea conditions, visibility, tides, road conditions, mechanical issues, official warnings or other safety concerns.
If Wild Riders cancels the entire activity before it begins for safety reasons, the amount paid will become a rescheduling credit under Section 6.
6Weather Credits and Rescheduling
- A credit issued because Wild Riders cancels for weather or safety is valid for 6 months from the original activity date.
- Wild Riders may extend the credit up to a maximum of 12 months at its discretion and only through written authorization.
- Rescheduling is subject to availability, seasonal pricing, equipment and operating zones.
- The customer must pay any positive price difference. No cash refund is issued if the replacement service costs less, unless Wild Riders agrees otherwise.
- Credits are non-refundable and non-transferable unless Wild Riders authorizes otherwise in writing.
Failure to use a credit before its expiration causes it to lapse without reimbursement.
7Changes, Routes and Delays
Schedules, routes, stops and duration are approximate and may be adjusted for safety, operating conditions, participant ability, traffic, tides or instructions from authorities. Reasonable changes that preserve the essential nature of the experience do not create an automatic right to a refund.
Customer-requested changes are subject to availability, price differences and written approval.
8No-Shows and Late Arrival
No-shows and missed activities are non-refundable. Participants must arrive at the time and location stated in the confirmation. A late arrival may reduce activity time or result in cancellation when it affects safety, other guests or operating schedules.
Transportation delays caused by an incorrect location, unavailable passenger or late departure attributable to the customer do not extend the activity.
9Participation and Driver Requirements
Participation may depend on age, height, weight, mobility, experience, valid identification, driver’s license or other activity-specific requirements communicated before service. Drivers must present the original valid license required by applicable law and the operator.
Wild Riders may assign passengers, vehicles or equipment to maintain safe operating limits. Customers must provide accurate participant information and request confirmation of any special requirement before booking.
10Children and Minor Participants
A parent or legal guardian must authorize each minor and sign any required waiver. A minor may not operate equipment unless permitted by applicable law, the operator’s rules and the responsible guide.
The parent or guardian remains responsible for supervision and for ensuring that the activity is suitable for the minor. Age and size restrictions may vary by activity and equipment.
11Safety Instructions and Protective Equipment
Participants must attend the safety briefing, follow all instructions, use required protective equipment and remain within authorized routes and operating areas. Helmets, flotation devices, seat belts or other safety equipment must be worn whenever instructed.
Participants may not race, perform stunts, leave the group, carry unauthorized passengers, feed wildlife or operate equipment recklessly.
12Waivers and Inherent Risks
Adventure and outdoor activities involve inherent risks that cannot be completely eliminated. Before participating, each adult—and the parent or legal guardian of each minor—may be required to sign an informed consent, assumption-of-risk and liability waiver.
Refusal to sign a required waiver means the participant cannot take part and does not create a right to a late refund. Nothing in these Terms excludes rights or liabilities that cannot legally be excluded under Costa Rican law.
13Health, Pregnancy and Accessibility
Participants must disclose any medical condition, pregnancy, recent surgery, physical limitation, allergy or medication that could materially affect safe participation. When uncertain, participants should obtain appropriate medical advice before reserving.
Wild Riders may restrict participation when reasonably necessary for safety. The company will make reasonable efforts to identify a suitable alternative, but accessibility varies by terrain, vehicle, vessel and third-party facility.
14Alcohol, Drugs and Impairment
A participant may not operate a vehicle, vessel, jet ski or other equipment while impaired by alcohol, illegal drugs, medication or any condition affecting judgment or coordination. Wild Riders may deny participation without refund when impairment or unsafe behavior is reasonably suspected.
Any beverage service is subject to Costa Rican law, age requirements and operator rules. Alcohol must never be consumed before or during the operation of motorized equipment.
15Equipment, Security Deposits and Damage
Participants must use vehicles, vessels, safety equipment and accessories carefully and only as instructed. The responsible customer may be charged for repair, replacement, recovery, towing, cleaning or third-party damage caused by negligence, reckless conduct, unauthorized use or failure to follow instructions, to the extent permitted by law.
Normal wear, mechanical failure not caused by the participant and pre-existing damage are excluded. Wild Riders may document equipment condition before and after use and may require a separate security deposit for certain rentals.
16Transportation and Pick-Up
Transportation is included only when stated in the confirmation. Pick-up times are approximate and may vary because of traffic, weather, road access or prior stops. Customers must provide an accurate hotel, villa or meeting location and remain reachable through the contact number supplied.
Oversized luggage, child seats, accessibility needs or unusual equipment must be disclosed before confirmation. Unscheduled route changes may result in additional charges.
17Third-Party Operators
Some activities may be provided by independent licensed operators, parks, transport companies or other suppliers. Their safety rules, waivers, schedules and reasonable participation requirements also apply. Wild Riders coordinates the reservation but does not control every act or omission of an independent supplier.
If a supplier makes a material change, Wild Riders will reasonably assist with an alternative, rescheduling or applicable supplier credit, subject to mandatory consumer rights.
18Personal Belongings
Participants are responsible for phones, cameras, passports, money, jewelry, luggage and other personal belongings. Outdoor and water activities may expose property to water, impact, dust or loss. Items should be secured appropriately and unnecessary valuables left in a safe place.
Wild Riders is not responsible for loss or damage except where caused by proven fault for which liability cannot lawfully be excluded.
19Photography and Promotional Media
Wild Riders may ask for separate permission before using identifiable photographs or videos for advertising or social media. A participant may decline promotional use without affecting the booked service. Consent for promotional media may be withdrawn for future use by contacting Wild Riders, subject to material already lawfully published or produced.
20Limitation of Liability
To the maximum extent permitted by law, Wild Riders is responsible only for direct loss proven to have resulted from its breach or legally attributable fault. It is not responsible for indirect or consequential losses, missed flights, lost profits, emotional disappointment or expenses arising from circumstances outside its reasonable control.
No provision limits liability for fraud, willful misconduct, gross negligence, personal injury caused by legally attributable fault, or any consumer right that cannot be waived under Costa Rican law.
21Force Majeure
Wild Riders is not liable for failure or delay caused by events beyond reasonable control, including severe weather, natural disasters, official restrictions, road closures, civil disturbance, public-health emergencies, utility failures or supplier interruption. Wild Riders may offer rescheduling, a credit or another remedy appropriate to the circumstances and applicable law.
22Conduct and Right to Refuse Service
Wild Riders may refuse, suspend or end participation when a person threatens safety, harasses others, damages property, disregards instructions, appears impaired, behaves unlawfully or disrupts the experience. When removal results from the participant’s conduct, payments are non-refundable and the participant remains responsible for resulting damage or costs.
23Personal Information and Communications
Personal information is processed according to the Wild Riders Privacy Policy. The customer agrees that reservation-related notices may be sent through email, telephone or WhatsApp using the contact details provided. Promotional messages require the consent applicable under law and may be declined.
24Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Costa Rica, including applicable consumer-protection rules. The parties should first attempt to resolve any concern in good faith by contacting wildriderscr@gmail.com.
If no resolution is reached, either party may use the competent administrative or judicial mechanisms available under Costa Rican law. Nothing in these Terms removes a consumer’s right to approach the competent authority.
25Entire Agreement, Severability and Updates
These Terms, the reservation confirmation, activity-specific waiver and Privacy Policy form the agreement for the booked service. If a conflict exists, the specific written reservation term controls for that booking, provided it is lawful.
If any provision is held invalid or unenforceable, the remaining provisions continue in effect. A failure to enforce a provision once is not a waiver. Wild Riders may update these Terms for future reservations by publishing a revised version and effective date. Material changes do not retroactively alter an already confirmed booking unless accepted by the customer or required by law.
